All services provided by Babies First Glance 3D/4D Ultrasounds Limited Liability Company, including all DBAs and subsidiary companies, are NON-REFUNDABLE once any portion of the appointment has begun. Because every pregnancy and every baby is unique, image quality and fetal cooperation may vary. YOU ARE PAYING FOR THE PERFORMANCE ON THE ULTRASOUND, NOT THE RESULTS, the technician’s time, and the use of specialized equipment, not for specific results or guaranteed images. When appropriate and at the STAFF DISCRETION ONLY, a one-time complimentary rescan may be offered if fetal positioning significantly limits imaging; this rescan is never guaranteed, is offered Monday through Thursday only, must occur within 7 to 21 days of the original appointment, and only one complimentary rescan may be provided. If fetal position, placenta placement, or other natural factors continue to limit imaging, no additional rescans will be offered. No refunds are issued for limited images, unclear views, facial detail, color variation, fetal position, or unmet expectations regarding results. By scheduling an appointment, you acknowledge, understand, and agree to the following legally binding terms: All ultrasound services (including 2D, 3D, 4D, 5D/HD bonding scans, early pregnancy confirmation, heartbeat checks, elective imaging, and gender scans) are elective and non-diagnostic. These services do not replace medical evaluation, testing, or care. Blood-based services, including gender tests and NIPT, are collected by Babies First Glance (BFG) but processed fully by independent third-party laboratories. Diagnostic ultrasound reports, when applicable, are interpreted solely by independent licensed radiologists who are not employees of BFG. Technicians are not physicians and cannot diagnose, interpret abnormalities, determine pregnancy viability, assess fetal growth, or offer medical advice. Any comments made by staff are non-medical and must not be relied upon for medical decisions. All medical concerns must be directed to your licensed healthcare provider. Ultrasound image clarity depends entirely on factors outside BFG’s control, including but not limited to fetal position, gestational age, maternal anatomy, placenta placement, fluid levels, and fetal movement. No specific images, poses, angles, clarity, heartbeat visualization, or facial detail are guaranteed. Gender determination, whether by ultrasound or blood test, cannot be guaranteed. BFG is not responsible for incorrect gender results due to fetal position, laboratory discrepancies, inconclusive findings, or natural variations. Refunds are not available for gender accuracy. Blood tests and NIPT services are processed by third-party laboratories. BFG is responsible only for the collection and shipment of samples and is not responsible for processing times, shipping delays, inconclusive results, lost samples, damaged samples, or inaccurate laboratory findings. One redraw may be offered for inconclusive results; refunds are not provided. Digital media such as photos, videos, USBs, downloads, and digital links are courtesy items. BFG is not responsible for corrupted files, expired links, misplacement, or device incompatibility issues. If concerning or unexpected observations occur during the ultrasound, such as the absence of visible movement or heartbeat, BFG cannot diagnose, interpret, or explain such findings. You assume all emotional risks associated with elective ultrasound and agree to follow up immediately with your licensed healthcare provider. Technical issues, equipment malfunctions, power outages, scheduling delays, shortened sessions, or required rescheduling do not qualify for refunds. Appointment availability and timing may vary. You are responsible for supervising your guests. BFG is not liable for injuries to guests or for lost, stolen, or damaged personal property. You agree to provide truthful and accurate information regarding pregnancy details and gestational age; BFG is not responsible for errors caused by inaccurate or incomplete information. To the fullest extent permitted by Florida law, the total liability of BFG, its owners, employees, contractors, radiologists, laboratories, affiliates, subsidiaries, DBAs, and all related entities is strictly limited to the amount paid for the service. No consequential, incidental, punitive, or emotional damages may be claimed. You agree to indemnify and hold harmless BFG and all associated individuals and entities from any claims, disputes, damages, or losses arising from your participation in BFG services. You agree not to publish or communicate any false, misleading, defamatory, or unverified statements about BFG. Any concerns must be addressed directly with management. You further agree not to dispute or charge back payments for services rendered, including dissatisfaction with images, fetal cooperation, laboratory delays, gender outcomes, or expectations about the experience. Any dispute arising out of or relating to BFG services shall be resolved exclusively through binding arbitration in the State of Florida. You waive the right to sue in court, the right to a jury trial, and the right to participate in any class action. This agreement survives the completion of services. These terms are governed exclusively by the laws of the State of Florida, and any permitted action shall be brought solely in Orange or Osceola County, Florida.
